Terms and Conditions

I have had many wonderful experiences with customers over the years but, as always, a terms and conditions of business is required plus a privacy policy.  I hope it can bring clarity between us and it is worth reading through.

Photography - Terms and Conditions

Photographer (Lorraine Mills), Company (Abundance Photography), Client/Customer (Customer or Licence Holder), JPG, Laminated Prints, Merchandise, Postcards, Images (Images, files and products offered by Abundance Photography)

Privacy Policy:  The Company does not lend, rent or sell any information given by the Client/Customer.

Use of Website:  The Company has provided a website for public use, any links put on the site are at the Client/Customers risk.  We do not claim responsibility for any trouble you have with your computer etc when using the Company’s website.  All photography on the Website is for viewing purposes only. There is no permission given whatsoever to copy any of the photographs displayed at www.abundancephotography.com www.lorrainemills.com www.abundancephotography.net

Grant of Rights:  Usage specification stated in this document convert to copyright licence (i.e. permission to use)

Payment:  For domestic sales, payment is required before the product is sent to the Client.  For trade and business sales, payment is due 30days from date of invoice with no exceptions made.  The Company is always looking for safe ways to receive payments electronically.  At time of payment, the Company has chosen the best way, within their knowledge, to receive payment from the Customer/Client, safely, quickly and as bilingual as possible.

Ownership and Copyright:  Photography licences are non exclusive and of restricted use that must be adhered to.  The Company never sells its images outright or copyright ownership therefore all files are loaned for use within an agreed licence only.  Unless clearly stated no Image or print is royalty free and an agreed fee must be paid to the Photographer for each copy made from either a print or JPG file.

Alterations:  The Company prides itself on the fact that none of the photographs offered are manipulated in Photoshop or any other photo adjustment software.  Written permission must be granted before anyone can alter the Images.  There is no permission given to write on the images.

Value, Storage, Image Deletion: The Client must store all licenced JPG files safely under their own insurance.  At the end of a licence, all JPG files on the Clients computer and backup copies must be deleted.  Legal action will be taken if a former Client is proved to be sharing, copying and/or selling the Company’s JPGs outside of licence.  You are asked to keep to the time frame agreed within a JPG licence.  The Company is not responsible for anything that happens to your computers, software, hardware whilst you store or use the Company’s JPG files.

Notice:  With regards to JPG licences, credit must be given and copyright shown on the back of or by each product. © L C Mills (year). Laminated prints from Abundance Photography do not contain copyright on the front, but have a label on the back, because these prints are sold under the specific intention to be framed.  This copyright notice must not be removed under any circumstances.  Omission of required notice results in loss to the Photographer and will be billed at triple the licence fee.  You cannot announce copyright over the Photographer’s work.

Assignment:  Client/Customer may not assign or transfer licences or any of the rights granted.  A licence binds and insures to the benefit of Photographer, Client, and Client’s employees, principals, agents, and affiliates, and their respective heirs, legal representatives, successors, and assigns.  Client and its employees are jointly and severally liable for the performance of all payments and other obligations created in this document.  No amendment or waiver of any terms in a License are binding unless set forth in writing and signed by the parties.

Dispute Resolution:  In the event of a breach of licence, copyright, non payment or failure to end a licence and delete all applicable files from the Client/Customer’s computers, the Photographer will bring charges against the client/customer under British Law in Great Britain at the discretion of the Photographer. The Client shall pay all legal costs, Photographers reasonable legal fees and expenses and legal interest on any award or judgment if granted in favour of the Photographer.

Official Third Party Suppliers:  Buying from official online services, galleries and management agencies dealing with Abundance Photography you are subject to their terms and conditions.  Please contact them directly.

Force Majeure:  Abundance Photography cannot be held responsible for loss of business or orders due to severe weather, earthquakes, flooding, landslides or any other unforeseen shifts that disrupt the services offered by the Company.

Unforeseen Circumstances:  In the event of the death of the Photographer or the closure of Abundance Photography, Licence holders will be contacted.

Licence Duration:  All licences will state a time duration which must be upheld.  The client can either extend a licence or finish it and delete all files from their computers and files.

Licence Agreement - Consideration:  Although the Company requires confirmation that the Client is happy and in agreement with a licence for legal consideration, e-mail confirmation, signed licences, storage and use of JPG files, all constitute as acceptance of the licence and these terms and conditions.

Art Projects:  For students, companies and clients:  Written permission must be obtained before creating any type of project that includes the photographs of the Company.  Before any type of project is undertaken, all projects must be agreed as joint ventures between the Company and the person applying for copyright permission.  With the full knowledge of the Company, all displays of works that include the Company’s photography must be displayed as an official collaboration project with full credit and permission details announced.  Absolutely all attempts to change the colouring of the photographs, digital manipulation, redesigning or forming as part of a collage will lead to legal action being taken.

Returns:  In the event that the client is unhappy with a laminated print it must be returned with the original receipt.  Another picture can be chosen or you can request your money back.  A JPG file is not easily returned and so the Company would not usually give a return, however, we encourage our clients and customers to contact us if they are not 100% happy with their product.

Cancellations:  The Company has the right to cancel any licence that appears to have become incorrect for the Photographer, Company employees or Company image with no costs incurred.  Clients wishing to finish a licence early, can do so, but the original payment is non refundable.

Changing the title of a Photograph or JPG File:  Legal action will be taken against anyone who covers over or erases the name and/or copyright of any Company photographs or who changes the name of a photograph or JPG file.

Facebook and other file sharing methods:  There is no permission given whatsoever to copy and upload a photograph or upload a JPG onto any website or networking site, including Facebook.  All displaying and file sharing will be in breach of terms and conditions and licences.  The company has their own Facebook page.

 

Healing Terms and Conditions for a healing session with Lorraine Mills

Lorraine = the healer.  You or your animal/child = the receiver.

 

Healing – Reflexology – Indian Head Massage - All the services offered by the healer do not replace medical treatment but can compliment the receiver’s journey to feel increased wellness and relaxation.

Mobile Service - The receiver is asked to pay the travel costs of the healer, both ways.  For the Swindon area this would be under £3.

Distance Healing Service - To be fair to the healer, the receiver must make themselves available for two phone calls, one before the healing session and one after the session, and to not work, watch television, drive a motor vehicle, operate machinery, smoke, take drugs, drink alcohol or read magazines/newspapers whilst the session is taking place.

Healing Animals - Animals will move away from the healer if they don’t want to be healed or have had enough energy.  The receiver is kindly asked to pay travel fees even in the event that the animal refuses a treatment.  No fee will be charged for under two minutes worth of treatment.  The pricing scale will be different for an animal and the price is between the healer and the owner of the animal.

Private and Confidentiality - Your sessions are private and confidential and all paperwork is kept private.  Your details are never sold or discussed or placed on networking sites such as Facebook.  In the event that the healer publishes books on healing and wants information for a book, via the website www.lorrainemills.com, you may be asked to volunteer healing stories if you wish and can work with the healer to produce helpful information for the public to read.  You may opt out of this request.

Obligation - It is better for the receiver to have sessions with a healer they really like.  There is no obligation to continue to book sessions with the healer.  The receiver is free to choose a healer they prefer.  If the receiver would like their session notes transferred to another healer – this is not a problem – and can be put into action at the receiver’s request.

Guarantee - There is no guarantee that a cure or vast improvement in your health can arise after having healing treatments.  Although many people have improvements in their life, the healer cannot guarantee a complete cure.  Healing services offered by the healer are therapeutic and are offered to bring small ongoing benefits into a receiver’s life.  Pressures such as demanding to be cured can not be entered into.   Most healings do not dissolve pain in one session.

Responsibility - The healer is not responsible for the receiver’s life working.  The receiver is asked to take responsibility for their own health, illnesses and actions before and after a healing treatment.

Healing Crisis – It is well known that after a healing session, symptoms can get worse before they clear.  After care information will be given to the receiver and the receiver is asked to be patient whilst a rough/turbulent period is experienced, if at all.  The receiver has the right to contact the healer again to discuss issues that are arising.

Booking a treatment – informs the healer that the receiver has read and agreed with the terms and conditions of healing and are willing to complete a consultation form and pay for any short notice cancellations or no shows.

In the event of an earthquake, flooding or adverse weather – The receiver is asked to cooperate with the healer in standard earthquake procedures.  In the event that flooding or prolonged adverse weather, such as a gale force winds, the healer will reschedule the booking, even at short notice.

Property Damage - Accidents – Every care is taken to make sure that a healing service is provided in a clean and safe environment, but you do enter healing rooms/event spaces at your own risk.  Your car is parked at our own risk too.

Cancellation – 24 hours notice is required for a cancellation, after that, half the cost is required.

No show - Not showing up for an appointment still requires you to pay half the cost.  You can do this via post, credit card or bank transfer.

No show at a mobile healing - If the healer arrives for a session and you are not in, you are still required to pay half the cost and the healers travel fee.

Telephoning to cancel - If you telephone to cancel an appointment and the healer is unable to take the call.  It is the receiver’s responsibility to call again.  If you can, please send an email to: therain@hotmail.co.jp

Emergency Call Out – The healer is not available for call out services but may work with existing customers at this level.  Distance healings may be available.  You are still welcome to call.  In the event that the receiver is a terminally patient, woman in labour, an animal or child, (i.e. a third party is calling on their behalf) the soul of the person needing the healing will be asked permission to go ahead and heal.  If the answer is a ‘no’, the healer can not go ahead with any healing work.  You will be required to fill out a consultation form via the internet.

Emergency Calls – Women in labour, sudden illness and accidents.  You are required to be with or to have called out medical assistance.  Distance healing may be available but permission from the patient is needed – verbally as well as on a soul level.  If verbal agreement cannot be accessed or the soul says ‘no’, the healer will not carry out a distance session.  You are still welcome to call.  You will be required to fill out a consultation form via the internet.

Gift Vouchers – Phoning for a friend – Fixing someone else’s problems or illnesses – It is understandable that you would like to see your friend/mate fit and well but making someone attend a treatment rarely works.  The healer will not accept appointments via a third party.  If the receiver is willing to have a treatment, and someone else is paying, the receiver must make the booking themselves.  Even in an emergency situation or in terminal illness, the person themselves or the soul must agree and be willing to receive a healing.  In a ‘giving a gift’ situation some people would like to decline but won’t want to hurt the feelings of the giver.

The word Master – Although the healer has taken a ‘masters’ qualification to teach and attune receivers to Reiki, the healer is in no way the receiver’s ‘master’.  The healer can channel energy and will guide and teach but the receiver is asked to take the responsibility of being both a student (learning new skills); a master (continuing to master one’s life) and opening up to receive light/healing energy.

Giving Blood – You will be refused a treatment of either Reflexology or Indian Head Massage on the same day you have given blood.

Migraines or Hangovers – Reflexology and Indian Head Massage treatments are not available to people who are suffering from a migraine or hangover at the appointment time.  These therapies can make things a lot worse.

Hospital Visits – I am available for hospital visits, however, will charge a travel fee and the Doctor, Ward Nurse and Patient all must agree to me attending and doing therapy within the hospital premises.

Mental Issues – Although Reiki, Indian Head Massage and Reflexology are therapeutic holistic therapies they may not be suitable for people who are bi-polar or are in care for mental disorders.  In these cases the patient must want to have a treatment and must be accompanied by a care worker.

Habitual Activities – The healer cannot guarantee any sort of advancement in the receiver’s health whilst they engage in unhelpful habits such as but not limited to:  seeking healing for the mind, body and spirit but continuing to exercise when injured or in pain or unwell; continuing to work when ill; drinking alcohol; drinking energy drinks; smoking; taking recreational drugs; sitting in unhelpful postures for long periods of time and resisting dealing with issues.  However, the healer understands, through her own journey how some habits are needed and not easy to shift but the receiver is asked seek a variety of lighter options within, food, drink, exercise and work to bring about successful changes.

Long term illness suffers – Reiki, Reflexology and Indian Head Massage cannot guarantee you complete or instant cures or a fast track back to returning to the workplace.

Privacy -
All customer details are kept private and confidential and are not sold, rented and shown to anyone else.  At the time of business, the company is using what they deem to be the best and most secure payment system available to them which has bilingual capabilities.  Your purchases are not discussed on any networking sites unless you have given permission for the company to show customer's comments or customer's purchases on official business networking sites.  For example:  The Abundance Photography Facebook Page.  The company's Orb Facebook Page.  The company's twitter account.


Li-Ana Essences - Li-Ana essenses are made in England

Li-Ana Essences Refunds - In the event that your bottle is damaged in transit, you may have a replacement essence that will be delivered to you, free of charge.  Refunds are not usually given for customers who have decided that the essence doesn't work.  If the energy of the essence is not what you had initially expected, we would ask you to work with the guardian angel on making the most from your relationship with the energy of Li-Ana, the crystal essences and other energies that have been blended into the water.  Positive feedback is always welcome.

Discount Shop Sales Terms and Conditions

Products in the online discount shop are all in good condition.  Exhibition prints that have hung on boards are glued into their paper mounts and have no plastic film over the photograph (to avoid overhead lighting glare).  If kept in direct sunlight, the paper mount and photograph can discolour.  Therefore, we would advise you to not hang or place your mounted print in areas that have direct sunlight on them.

Mounted Frames  - Although paper frames are sturdy in appearance, if dropped on the floor, the corner or corners will dent.  Please handle your mounted print with a some care.

Hanging a Print with BlueTac - BlueTac is not an ideal medium to hang a print by.  In summer temperatures around and over twenty five degrees, BlueTac will soften and the weight of the product will cause the mount to fall.

Discount Shop Refunds - We feel you will be delighted with your purchases from this site.  It is not usual for refunds to be given for second hand products - however if you feel you have a genuine reason why you would like to return the discounted product, you may contact us within fourteen days of receipt, email a copy of the original receipt, send the product back at your expense and you may have a full refund.

Import Fees - You, the buyer, are responsibile for any import fees that you might incur whilst buying and shipping products from this website into your country of residence.  It is recommended that you look at your own country's Custom and Excise charts and find out the rates currently in force.  For example, the UK has a limit of up to eighteen GBP before import fees are charged.  Please go ahead and order what you really want and your purchases may arrive in separate envelopes.

Special Ocassions Delivery Deadlines - For specific dates like birthdays, valentines, christmas etc, please try to order six weeks in advance to make absolutely sure your purchases arrive in time.
